The Role of a Commissioner for Oaths
Commissioners for oaths are authorized by the Notaries and Commissioners Act. They’re regulated by the Ministry of Justice and Solicitor General in Alberta. A commissioner for oaths must be at least an 18-year-old Canadian citizen or a permanent resident living in Alberta. The individual must be appointed as a commissioner for oaths by the Province of Alberta.
A commissioner for oaths is authorized to administer oaths. They can also take and receive affidavits, affirmations, and statutory declarations for use in legal proceedings. This position isn’t the same as a notary public. Thus, commissioners for oaths can’t certify true copies of documents. Their role is restricted to administering and affirmations.
All documents that are supposed to be filed in courts should be commissioned at the court registry. For other legal documents, it’s best to consult our experienced lawyers or other notary service. According to Section 4(1) of Alberta’s Notaries & Commissioners Act, notaries public can administer oaths. They can also take a statutory declaration or affirmation and attest to an oath, affidavit, declaration, and affirmation.
Additionally, a notary public can certify and attest true copies of documents. They can certify or witness and attest to the execution of a legal document. Unlike commissioners of oaths, a notary public has a notary stamp and a seal when they sign off original documents.
Pre-Appointment
According to the Evidence Act, the Minister of Justice can appoint individuals as commissioners for oaths. Suppose you want to become a commissioner for oaths. In that case, you should submit a completed pre-appointment checklist that comprises a completed examination form, a completed application form, and a payment of $75.
Therefore, you must answer every examination question correctly for your application to be accepted. Once approved, you will get a certificate of appointment as a recognized commissioner of oaths in Alberta.
